The agreement also covers the use of any assigned toll-free and/or local number, LongCode and/or ShortCode account used in connection with the services. The terms and conditions may be changed by Speaq.ai at any time and the user is responsible for reviewing them periodically. By using Speaq.ai's services, registering for an account, or using their website, the user agrees to be bound by and comply with the terms outlined in the agreement.

USAGE POLICY

The terms and conditions may be changed by Speaq.ai at any time, and the user is responsible for reviewing them periodically. By using Speaq.ai's services, registering for an account, or using their website or subdomains, the user agrees to be bound by and comply with the terms outlined in the agreement.

OWNERSHIP

This section outlines the usage policy for Speaq.ai's virtual telecommunication services and any related products or services. The user represents and warrants that they are at least 18 years of age or the applicable state age of majority and that they possess the legal right and ability to enter into this Agreement. The user agrees not to use the services for any unlawful or abusive purpose or in any way that interferes with Speaq.ai's ability to provide services to other customers, or damages their property. The user is solely responsible for all uses of the website, services, and account with their UserID and Password. If their services or accounts are fraudulently used, the user agrees to immediately notify Speaq.ai. They have the right to interrupt, restrict or terminate services to the user's account without notice, if they suspect fraudulent or abusive activity. The user must provide clear opt-out/unsubscribe information, adhere to the Consumer Best Practices Guidelines and comply with the Do-Not-Call (DNC) status requests. The user is responsible for familiarizing themselves with and abide by all applicable local, state, national and international laws and regulations and are solely responsible for all acts or omissions that occur under their account, and must schedule campaigns responsibly and in a manner that is courteous to the recipients and obtain any rights or licenses to any data, including without limitation sound files, for inclusion in any outbound messages, broadcasts, and campaigns. The user must familiarize themselves with the legalities of any messages, calls, broadcasts, and campaigns transmitted through the Speaq.ai Services and must not send unsolicited marketing messages or broadcasts (i.e. spam), harvesting, or otherwise collecting information about others, without their consent, misleading others as to the identity of the sender. The services provided are intended for professional use only.

IP

All Materials, Services, Accounts and content, including but not limited to policy information, text, software, music, sound, photographs, video, graphics, the arrangement of text and images, commercially produced information, and other material contained on the Site or through the Services (“Content”), are provided by Speaq.ai unless indicated otherwise. All intellectual property rights in the Materials, Content, Services and Accounts (including copyrights, trademarks, service marks, trade secrets and patents) are the property of Speaq.ai. Speaq.ai retains all copyrights in the individual pages, and their components, and collective works available at the Site.

The Materials, Content, Services and Accounts are copyrighted and are protected by federal and worldwide copyright laws and treaty provisions. They may not be copied, reproduced, modified, published, uploaded, posted, transmitted, performed, or distributed in any way without Speaq.ai's prior written permission.

Trademarks and copyrights including Speaq.ai, and the Speaq.ai logo are the property of Speaq.ai. All other names and trademarks are the property of their respective holders.

This Agreement is a seat license agreement for access to the product only. The user is not being granted any ownership or license of any kind to the source code, object code, or data related to the Product (Software). Therefore the user agrees that it does not have any right, and it will not remove any proprietary or trademark notices, labels or logos from any message sent through the Product, nor will user modify, translate or create any derivative works based on or related to the Software.

The term of this Agreement begins on the date Speaq.ai activate Services for the user's Account. This Agreement will continue from month to month until terminated by either party pursuant to the terms hereof.

LIALBILITY

The user is responsible for paying all charges to their account for services, including but not limited to, long distance and regulatory and government fees, and for all taxes and surcharges, including regulatory recovery fees, imposed on them or Speaq.ai as a result of their use of the Services. Each service plan, for both toll-free and local numbers, has (i) a flat monthly service fee (this service fee, which is posted on the website, is the basic charge associated with the service. This fee includes the calling charges defined by the service plan within the continental United States (excluding Alaska, Hawaii and United States territories such as Puerto Rico) and Canada); (ii) a certain number of “free” minutes to be used in the continental United States (excluding Alaska and Hawaii and United States territories such as Puerto Rico) and Canada as posted on the website, and (iii) an additional minute rate (if the user exceed the number of calling minutes on their service plan, Speaq.ai will bill them for the minutes they use above their allowance) as posted on the website.

International calls (not including calls to Canada) and calls to areas outside the continental United States (including, but not limited to, Alaska and Hawaii and United States territories such as Puerto Rico), including calls forwarded from the continental United States and Canada to such international areas, are charged based on current international outbound rates. FEES AND SUBSCIPTIONS

By using the SPEAQ.AI website, the user agrees to pay all applicable fees related to their use of the website which are described on the pricing page. By providing a payment method, the user authorizes SPEAQ.AI to charge the applicable fees, taxes and other charges on said payment method at regular intervals, all of which depend on the user's subscription and utilized services. The subscription period can be month-to-month, yearly or another duration described on the pricing page. Subscriptions are subject to fees based on the selected account type and for renewals, SPEAQ.AI will automatically charge the user's payment method for the current fee for their account type plus taxes. All payments are non-refundable. If applicable, the user must maintain current billing information and by creating a subscription, they consent to allow SPEAQ.AI to charge their payment method for the amounts due for the initial and additional subscription periods until the account is canceled or terminated. The user is advised to print out these terms and conditions for their records. By using SPEAQ.AI , subscriptions will automatically renew for the same period unless the user cancels their account before the end of the current subscription period. Users can cancel their account at any time by contacting customer service at info @ speaq.ai . Cancellation will be effective immediately. Keep in mind that after canceling the account, the user will not be able to access the platform and will not receive a refund of any fees that they have paid.

LEGAL LAWS

By using speaq.ai, you are agreeing to comply with all applicable laws, regulations, and ordinances regarding your use of the platform. speaq.ai reserves the right to investigate any violations of these terms and take appropriate action, including canceling the user's account and reporting any suspicious activity to the relevant authorities. The user is also responsible to promptly notify speaq.ai in case of any unauthorized or illegal use of the platform.

LIMITATION OF LIABLITY

Speaq.ai will not be liable for any damages resulting from your use of the website. They will not be held responsible for any indirect, extraordinary, exemplary, punitive, special, incidental or consequential damages. speaq.ai maximum aggregate liability is limited to the greater of the amount paid by you in the last 12 months or $100. This limitation of liability is a part of the agreement and applies to all claims of liability.
